DECREE OF THE PRESIDENT OF THE REPUBLIC OF BELARUS December 17, 2002 N 28 ON STATE REGULATION OF PRODUCTION, TURNOVER AND CONSUMPTION OF TOBACCO RAW MATERIALS AND TOBACCO PRODUCTS (as amended by Decrees of the President of the Republic of Belarus dated 01/24/2019 N 2, dated 05/21/2020 N 2, dated 11/16/2020 N 4)
CHAPTER 11 STATE REGULATION OF SMOKING (CONSUMPTION) OF TOBACCO PRODUCTS, USE OF ELECTRONIC SMOKING SYSTEMS, SYSTEMS FOR TOBACCO CONSUMPTION
35. Smoking (consumption) of tobacco products, the use of electronic smoking systems, systems for tobacco consumption (hereinafter referred to as smoking) are prohibited:
- in elevators and auxiliary premises of multi-apartment residential buildings, dormitories;
- on children's playgrounds;
- at workplaces organized on premises;
- in the territories and premises occupied by sports, recreational and other camps;
- in premises and territories occupied by educational institutions, organizations implementing educational programs of postgraduate education;
- in underground passages, at metro stations;
- at stopping points on the routes of automobile transportation of passengers and transportation of passengers by urban electric transport, landing sites used for boarding and disembarking passengers; in all types of public transport, except for those specified in paragraph eleven of part two of this paragraph;
- in cars if there are children under 14 years of age in them;
- in other places determined by the legislative acts of the Republic of Belarus.
Smoking is prohibited, except in specially designated places:
- in retail facilities and consumer services facilities, shopping centers and markets;
- in public catering facilities, on the territory of summer areas (extensions of halls);
- within the boundaries of territories occupied by beaches;
- in territories and premises occupied by physical culture and sports organizations, physical culture and sports facilities;
- in industrial buildings (premises);
- in premises and territories occupied by government bodies, cultural and healthcare organizations, sanatorium-resort and health-improving organizations, organizations providing communication services, social, banking, insurance, hotel and other services, as well as organizations, individual entrepreneurs who, in accordance with the legislation of the Republic of Belarus, are granted the right to carry out educational activities, with the exception of those indicated in paragraph six of part one of this paragraph;
- in premises intended for receiving citizens, including on issues related to the implementation of administrative procedures;
- in the premises of passenger terminals of road transport, ports and airports; - in the premises and territories of railway stations intended to serve passengers of public railway transport; - on sea vessels, mixed (river - sea) navigation vessels.
Legal entities and individual entrepreneurs, in whose ownership, economic management, operational management or on any other legal basis the objects specified in part two of this paragraph are located, create (allocate) special places on the territories of these objects or smoking rooms, equipped in the prescribed manner and marked with a sign “Smoking area”.
Organizations- manufacturers of tobacco products have the right to carry out tasting of tobacco products and raw tobacco in production buildings (premises) in the manner established by these manufacturing organizations.
36. At the objects specified in paragraphs two - nine and eleven of part one and part two of paragraph 35 of these Regulations, legal entities and individual entrepreneurs, in the ownership, economic management, operational management or on another legal basis of which these objects are located, place a sign prohibiting smoking. The model and requirements for placement of such a sign are established by the Ministry of Health.
A sample sign prohibiting smoking (consumption) of tobacco products, the use of electronic smoking systems, systems for tobacco consumption is established by Resolution of the Ministry of Health of the Republic of Belarus dated April 19, 2019 N 35:
2. Determine that:
2.1. a sign prohibiting smoking is placed at the entrance to premises, facilities and (or) territories where smoking (consumption) of tobacco products, the use of electronic smoking systems, systems for tobacco consumption (hereinafter referred to as smoking) is prohibited in accordance with legislative acts, or within the boundaries of such premises, facilities and (or) territories;
2.2. organizations providing hotel and other services place a smoking ban sign in the places specified in subclause 2.1 of this clause and near the place for registration of residence;
2.3. legal entities and individual entrepreneurs have the right, in addition to the places specified in subparagraphs 2.1 and 2.2 of this paragraph, to place a sign prohibiting smoking in premises, facilities and (or) territories belonging to them by right of ownership, economic management, operational management or on other legal grounds, where smoking is prohibited in accordance with legislative acts;
2.4. the size of the no-smoking sign must ensure its visibility;
2.5. a color graphic image of a smoking ban sign is applied using various technologies to the surface of a carrier material, including metal, plastic, silicate or organic glass, self-adhesive polymer film, self-adhesive and printed paper, cardboard;
2.6. It is allowed to accompany the smoking ban sign with the inscriptions “No smoking”, “No smoking” and (or) information about the amount of fines for smoking in prohibited places. Sample of a no smoking sign:
